A Vietnam vet and owner of a Wisconsin motorcycle shop was killed Saturday after fleeing a hostage situation, only to be gunned down by police. Now his longtime business partner says officers “shot the wrong guy.”

Michael “M.L.” Funk, 60, was at Eagle Nation Cycles in Neenah around 9 a.m. when an unidentified gunman wielding a MAC-10 held him and several others captive in what became an hours-long standoff with police.

When cops arrived, a suspect inside the building fired at them, striking one officer’s helmet, and the officers retreated, Neenah Police Chief Kevin Wilkinson said.

Shortly after, a man later identified as Funk exited the motorcycle shop. He was “shot at by one or more officers on scene” after he didn’t obey orders to drop his weapon, Wilkinson told reporters.

The alleged hostage-taker surrendered around 1 p.m., police said. On Monday, authorities identified the alleged gunman as Brian T. Flatoff, 45, of Neenah.

Flatoff is charged with first-degree recklessly endangering safety with a firearm related to an “incident” prior to the hostage standoff, the Appleton Post-Crescent reported. The Winnebago County District Attorney’s office announced plans to file more charges this week against Flatoff, who has a history of drunken driving offenses.

The long-haired and bushy-bearded suspect, who owns a local tattoo shop, reportedly had no connection to the shop owners.

Still, the stickup resulted in Funk being shot and later dying at the hospital. Funk was “terrified of police” following a dramatic 2012 raid on his business, his attorney, Cole White, told The Daily Beast.

Funk and Eagle Nation co-owner Steven “Mad” Erato were embroiled in a $50 million lawsuit against the city of Neenah—about 85 miles northwest of Milwaukee—over the alleged Sons of Anarchy-style crackdown.

White, who represents Eagle Nation Cycles, stressed that Funk was a hostage on Saturday, not the instigator of the standoff. “Mike was a hostage that was trying to flee the scene and was killed as a result of that,” he told The Daily Beast. “Whether it was justified or not… time is going to tell us that.”

“In my experience, just because police put out a press release and say something, doesn’t mean that’s the way it went down,” White added.

Steven “Mad” Erato had stronger words about the police response.

The mechanics also made news for launching a new political faction: the American Biker Party.

“He was a hostage coming out,” Erato told theAppleton Post-Crescent. “They shot him in the alley. They shot the wrong guy.”

While police haven’t released a motive in the alleged crime, White said the gunman attacked Eagle Nation because he wanted to retrieve his motorcycle, which had been sold to another person and was being repaired at the shop.

“There have been reports that [the gunman] was on probation, had another case pending, [and] sold his bike to raise money for his legal fees,” White told The Daily Beast. “Then he decided after he got that money, he wanted the bike back.”

The mother of a 15-year-old boy who police say was pointing a gun at an officer before the officer shot him has not been allowed to visit him at Children’s Hospital of Wisconsin, the boy’s attorney said Tuesday.

The teen, identified by his family as Kevin Cole, was shot in the side shortly before 5 p.m. Friday in the 3700 block of N. 26th St., police said.

“It’s very difficult for parents,” attorney Craig Mastantuono said. “Whether he’s accused of wrongdoing, he hasn’t been seen by his mom since Friday.”

Police Department policy prohibits hospitalized prisoners from receiving visitors, spokesman Lt. Mark Stanmeyer said Tuesday in an email.

Mastantuono said he and Kevin’s mother were denied access to the teen earlier Tuesday. Mastantuono said he believes access should be authorized at the request of a parent, but said he has not been able to reach an agreement with police or hospital officials.

Preliminary information provided by police indicates Cole pointed a loaded, semiautomatic handgun at a Milwaukee police officer before the officer shot him in the side.

The shooting occurred after officers assigned to police District 5 were sent to the 2600 block of W. Nash St., where the ShotSpotter location system had detected gunshots. The officers stopped a 16-year-old boy and Cole.

Cole ran to the 3700 block of N. 25th St., where the shooting occurred, and he was taken into custody after he was seriously wounded, according to police.

Police said the second boy also was arrested. The case has not yet been presented the case to the Milwaukee County district attorney’s office, Stanmeyer said Tuesday.

The officer involved is a 42-year-old man with 13 years of service and was placed on administrative duty pending the outcome of the investigation, which is standard department policy.

Just moments after a Milwaukee police officer shot a 15-year-old on Milwaukee’s north side, the situation was caught on camera.

Police say the teen was armed.

She was surrounded by supporters at her home on Saturday as her son remains in police custody at Children’s Hospital.

For the first time, we see the intense moments following an officer-involved shooting near 26th and Nash.

A 15-year-old lays on the ground as officers rush on the scene. Cell phone video was taken by witness Alonzo Martin from Milwaukee, and showed to FOX6 News by the wounded teenager’s mother.

“I just don’t understand. I just don’t understand,” said Tamara Cole, Kevin Cole’s mother.

Police responded to the area on Friday, April 24th, after a report of shots fired. Authorities say officers stopped two teens.

During that stop, 15-year-old Kevin Cole was shot. Police say he was armed with a semi-automatic handgun.

“He wasn’t shooting at him, he was fleeing,” said Tamara Cole.

Tamara Cole hasn’t been able to see her son.

“I want to see my baby. I want to make sure he’s alive, myself,” said Tamara Cole.

Cole is in police custody at Children’s Hospital.

“Kevin is a good kid,” said Tamara Cole.

Police say the teen has an arrest record. His mom says he’s not a criminal.

“He doesn’t have any type of felonies, never been in trouble, doesn’t do drugs,” said Tamara Cole.

Saturday, supporters surround the family home. Cole’s grandmother is in disbelief.

“He didn’t have a gun, he didn’t have a gun. My heart is hurting because that’s my oldest grandson,” said Ruthie Cole, Kevin Cole’s grandma.

This family is demanding answers, as an investigation continues.

The officer involved has been placed on administrative duty pending the outcome of the investigation.

Meantime, the teen’s current condition is unknown — but Friday night, April 24th, police tell FOX6 News his condition was serious, but stable.

MADISON, Wis. — Members of the protest group Young, Gifted and Black are calling for the United Nations to independently investigate a Wisconsin police officer who killed Tony Robinson, a 19-year-old unarmed man. The protesters insist there is no way the current investigation of the killing by the Wisconsin Department of Justice can be fair or accurate.

The Wisconsin Department of Justice finished its investigation last week, but their findings have not yet been made public. Protesters point out that state agents in charge of the probe are themselves former police officers, citing it as a primary reason why they are seeking an investigation from outside “authorities.”

Madison Police officer Matt Kenny shot Robinson in an apartment house near the Wisconsin Capitol building on March 6 during a response to an emergency call that Robinson was attacking others and acting erratically. Police say Robinson, who was unarmed, assaulted Kenny in the apartment, but have released no further details. Protests began immediately following the shooting, where many compared the killing to the death of Mike Brown in Ferguson, Mo.

Wisconsin state law requires outside agencies to investigate officer-involved deaths, prompting the investigation by the Wisconsin Department of Justice. The agency turned over its findings to District Attorney Ismael Ozanne in late March. Ozanne has yet to decide whether to file criminal charges against Kenny.

Madison Police also released a police dash-cam video of another incident in which officer Kenny shot and killed Ronald Brandon in 2007. Kenny was cleared of any wrongdoing. Police claim Brandon pointed a gun at the police prior to being killed. The video obtained by the Associated Press was redacted and did not show the actual shooting, but does appear to show Brandon pointing a gun at officers before he was shot.
